If information you provided to Aveanna was potentially compromised
in a July 2019 cyber security incident, you may be eligible
for benefits from a data breach class action settlement.

A court authorized this notice.  This is not a solicitation from a lawyer.

•     A settlement (the “Settlement”) has been proposed with Aveanna Healthcare, LLC (“Aveanna”) in a class action lawsuit about an alleged cyber security incident that purportedly placed at risk certain Personally Identifiable Information (“PII”) in July 2019 (the “Security Incident”).  Aveanna denies all of the claims.  The Settlement does not establish who is correct and is not an admission of fault, but rather is a compromise to end the lawsuit.

•     The “Settlement Class” includes all persons whose PII was received by, gathered by, shared with, obtained by, or otherwise came into the possession of Aveanna and was potentially compromised in the Security Incident, except for (i) those persons who timely and validly request exclusion from the Settlement Class; and (ii) any other person found by a court of competent jurisdiction to be guilty under criminal law of initiating, causing, aiding or abetting the criminal activity or occurrence of the Security Incident or who pleads nolo contendere to any such charge.

•     The Settlement provides payments to eligible members of the Settlement Class (“Settlement Class Members”) who submit valid claims for certain documented unreimbursed out-of-pocket expenses and certain time spent that resulted from the Security Incident.  The Settlement also provides to all Settlement Class Members the eligibility to enroll in up to five years of free identity theft protection services from Equifax.

Your legal rights are affected even if you do nothing.  Read this notice carefully.

Your Legal Rights and Options in this Settlement

Submit a Claim

This is the only way to get benefits under the Settlement.

Ask to be Excluded

Get no benefits. This is the only option that allows you to bring your own lawsuit against Aveanna related to the Security Incident.

Object

Write to the Court about why you do not think the Settlement is fair, reasonable, or adequate.

Go to the Hearing

Ask to speak in Court about the fairness of the Settlement.

Do Nothing

Get no benefits.  Give up rights to submit a claim or bring a different lawsuit against Aveanna related to the Security Incident.

 

 

•     These rights and options—and the deadlines to exercise them—are explained in this notice.

•     The Court in charge of this case still has to decide whether to grant final approval of the Settlement.  No payments will be made and no enrollment for identity theft protection services will be available until after the Court grants final approval of the Settlement and all appeals, if any, are resolved.
